Role of the Court

The Children’s Court of Victoria operates under the Children, Youth and Families Act 2005 (PDF 1.5 Mb) as a specialist court with two divisions to deal with matters relating to children and young people.

The Family Division hears:
  • applications relating to the protection and care of children and young persons at risk, and
  • applications for intervention orders
The Criminal Division hears:
  • matters relating to criminal offending by children and young persons.
The Children's Koori Court (Criminal Division) hears:
  • matters relating to criminal offending by Koori children and young persons, other than sexual offences.
Family Court of Australia

On occasion, members of the public confuse the work of the Family Division of the Children’s Court of Victoria with that of the Family Court of Australia. The Family Court is a Federal Court established under the Family Law Act 1975 (Commonwealth). The Family Court has responsibilities which include granting divorces (dissolution of marriage), and associated matters such as child residence and contact arrangements, maintenance and property issues.
